Transmission From Heck 33 and 1/3

Well,
It's been 3 months since http://www.mx-3.com/phpBB3/viewtopic.php?f=30&t=69986 Part 1 and http://www.mx-3.com/phpBB3/viewtopic.php?f=30&t=70804 part 2 of the Transmission from heck saga.
Long story short, for those who don't want to read... the car drives for 115 miles before the transmission overheats and throws fluid out the fill tube.
The latest...
I purchased an ECU off of Ebay. I'm sure it was salvage, but it shouldn't have mattered in this case... I highly doubt two ECU's are going to cause the same issue with the Transmission. They said it was "not locking up" properly.
Anyway. The first chance I got to drive to Orlando again since part 2 ended was last week, and the Tranny went into meltdown on the way up after about 115 miles. So I drove it, limping and spewing, into the shop, explaining to them that I replaced the ECU, the harness was inspected, and at this point, it's gotta be the Transmission. So...
They 'claim' they bought a new transmission (took it a week to get out from Cali), they put the transmission on... and it's still having problems.
My question to you:
ASIDE FROM A TRANSMISSION, what could cause a transmission to overheat and throw fluid, or bang through gears, as they claim it is now doing? Odd as it is, by the way, that there was no banging before. I think I'm getting raped.
Thanks guys,
dan s.
